FERPA Notice
Effective Date: April 11, 2025
This FERPA Notice explains the rights of students, parents, and educational institutions under the Family Educational Rights and Privacy Act (“FERPA”) when using ĀYŌDÈ (The Organization for the Advancement of Youth through Opportunities in Digital Education) Services.
FERPA is a U.S. federal law that protects the privacy of student education records.
1. Applicability of FERPA
FERPA applies when:
- ĀYŌDÈ provides services to educational agencies or institutions.
- Personally Identifiable Information (“PII”) from student education records is collected, maintained, or processed.
ĀYŌDÈ acts as a “School Official” under FERPA when providing services to schools, subject to FERPA’s restrictions on use and disclosure of student data.
2. Student Rights Under FERPA
Students and parents (if the student is under 18 or a dependent) have the right to:
- Access and review education records maintained by their school.
- Request corrections to education records they believe are inaccurate.
- Provide written consent before disclosure of PII from education records, except in certain permitted situations.
Requests for access or correction must be directed to the applicable school or educational institution, not ĀYŌDÈ directly.
3. How ĀYŌDÈ Protects Student Data
ĀYŌDÈ complies with FERPA by:
- Using student data only to provide contracted services to schools.
- Not disclosing student data to third parties without school authorization or as permitted by law.
- Implementing administrative, technical, and physical safeguards to protect student data.
- Requiring confidentiality agreements with personnel who access student data.
- Deleting or returning student data upon termination of services as directed by the school.
4. Permitted Disclosures
ĀYŌDÈ may disclose student data without consent:
- To authorized school officials with legitimate educational interests.
- When required by law or valid legal process.
- In a health or safety emergency, as permitted by FERPA.
ĀYŌDÈ does not sell student data.
